2) Scope of the contract
These Terms govern the use of the MyHomesBudget web app (“Service”) for personal/household budgeting. The user is granted a non-exclusive, non-transferable, revocable licence for personal and non-commercial purposes only.
3) Eligibility (18+), registration & account
- Minimum age: 18 years old.
- Registration: email/password, magic link or Google (GIS). The user must provide accurate information and keep it updated.
- Credentials: the user is responsible for safeguarding credentials and for activities carried out through the account.
- Consumer use: the Service targets consumers; B2B purchases are not available at this time.
4) Plans, prices and territories
- Territories: worldwide sales.
- Currencies & price lists: EUR, USD and GBP with fixed local pricing:

- USD — Plus $2.99/m · $29.90/y · Pro $4.99/m · $49.90/y
- GBP — Plus £2.99/m · £29.90/y · Pro £4.99/m · £49.90/y
- Price changes: any increase is notified with 60 days advance notice by email and on the website; the user may cancel before it becomes effective.
5) Free trial (Starter 30 days)
- Starter: 30-day free access, full features, no card required.
- At the end: the account becomes read-only with a paywall for upgrade.
- Data retention: if no upgrade follows, data may be retained up to 12 months (see Privacy) and then deleted.
6) Payments, renewals and invoicing
- Methods: primary checkout via Stripe Checkout (with Apple Pay/Google Pay); alternative PayPal Subscriptions.
- Auto-renewal: applies to Plus/Pro monthly or yearly plans until cancellation.
- Dunning (failed payment): automatic retries; 1-day grace period. After that, access may be limited/suspended.
- Invoicing & taxes: Stripe Tax determines applicable taxes by country. A platform receipt is issued upon payment; the tax invoice is issued by the Owner with his own invoicing software and emailed within 10 business days from settlement.

”. - Customer data: purchases are for consumers; an optional Tax Code field is available. B2B (VAT) sales are not enabled at this time.
- Currency: charges occur in the currency of the selected plan (EUR/USD/GBP).
7) Consumer withdrawal & cancellation
- Right of withdrawal (14 days): for distance contracts, EU/UK consumers may withdraw within 14 days. If performance has begun, a pro-rata charge applies for the portion used; any refund covers the unused portion.
- Cancellation (Plus/Pro): takes effect at the end of the current term; no refund of the unused fraction.
- Chargeback/disputes: upon payment dispute the account may be immediately suspended (read-only) until resolution.
8) Upgrades, downgrades & changes
- Upgrade: effective immediately under the payment provider’s rules; proration may apply.
- Downgrade (Pro→Plus): effective at the end of the billing period.
- Billing period switch (monthly/yearly): applied at term end unless otherwise shown at checkout.
9) Technical limits, suspensions and termination
- Limitations: without an active plan or after trial end, accounts may be set to read-only.
- Suspension: in case of breach, abuse, fraud or security risks, the Owner may suspend access (in whole or in part) and request clarifications.
- Termination: the Owner may terminate for cause, including repeated non-payment or serious violations.
10) Acceptable use & content
- Unlawful, defamatory, fraudulent or rights-infringing use is prohibited.
- Users should not enter unnecessary special-category data (e.g., health, religion/politics). See Privacy for details.
- Mass extraction and reverse engineering are prohibited except as allowed by mandatory law.
11) Intellectual property
The software, trademarks, logos, design and UI are protected. No IP rights are transferred; only a limited personal licence is granted.
12) Personal data & privacy
Processing follows our Privacy & Cookie Policy (auth via Supabase/GIS, security measures, RLS, backups, post-closure retention up to 12 months, user rights, cookies/analytics).
13) Liability and warranties
- “As is”/best-effort: no warranty of result or uninterrupted availability; maintenance, third-party outages or updates may affect the Service.
- Exclusions: to the maximum extent permitted, no liability for indirect or consequential damages (lost profits, loss of opportunity, reputation, data loss not due to wilful misconduct/gross negligence by the Owner).
- Liability cap: the Owner’s aggregate liability to the user is limited to the amount paid for the Service in the last month. For free users: cap €0.
- Carve-out: no limitation where forbidden by law (death/personal injury, wilful misconduct or gross negligence, fraud, non-waivable consumer rights).
14) Force majeure
The Owner is not liable for failures due to events beyond reasonable control (e.g., natural disasters, blackouts, acts of authorities, wars, cyber-attacks on third-party infrastructure, outages of hosting/CDN/identity/payment providers). Performance is suspended for the duration of such events.
15) Amendments to Terms & pricing
- Terms: changes are notified with reasonable advance (typically 30 days) and published here. Continued use after the effective date implies acceptance.
- Pricing: changes with 60 days notice; the user may cancel before they take effect.
16) Governing law and venue
These Terms are governed by Italian law. For disputes between businesses (B2B), the exclusive venue is Como (Italy). For consumers (B2C), mandatory jurisdiction of the courts of the consumer’s place of residence/domicile applies.
17) Miscellaneous
- Severability: invalidity of a clause does not affect the remainder.
- Assignment: the user may not assign without written consent; the Owner may assign in case of corporate reorganisation, subject to Privacy safeguards.
- Languages: translations may be provided; in case of conflict, the Italian version prevails.
- Post-closure retention: as per Privacy, up to 12 months for backups/logs unless different legal obligations apply.
- Data export: the user may request an export (e.g., CSV) before closure.
